What Prop 318 would actually do

Arizona already restricts trans girls from competing on female school sports teams. Prop 318 would mirror that restriction for trans boys on male teams, then go much further. It would apply the same rules to every school in the state, public and private, and it would ban trans students and employees from using bathrooms, locker rooms, shower rooms, and any other private space that does not match their birth certificate sex. It would also, as the ACLU of Arizona's Darrell Hill pointed out, apply to spectators at sporting events. Not athletes. Spectators. People who turned up to watch a game.

That last detail tells you something about what this measure is really trying to do. This is not a narrow rule about elite competition. It is a piece of legislation that would reach into the most ordinary moments of a trans person's day, the school corridor, the changing room before PE, the toilets at a Saturday afternoon match, and make every one of them a legal question.

The San Francisco-based US Court of Appeals for the Ninth Circuit ruled on Oct. 6 in Roe v. Johnston that because Arizona’s statute governing amendments to birth certificates does not require a “sex change operation” as a prerequisite for getting an amended birth certificate, Senior US District Court Judge James A. Soto erred by awarding an injunction to transgender plaintiffs who had been unsuccessful in obtaining court orders from state judges to direct the Arizona Department of Health Services to provide them with amended birth certificates.

A two-judge panel of the Ninth Circuit unleashed a previously blocked Arizona law Tuesday requiring transgender people to submit a written statement from a doctor that they had a sex reassignment surgery in order to change their birth certificate.

“The panel held that Arizona’s birth certificate amendment statute does not violate the equal protection clause,” U.S. Circuit Judge Roopali Desai, a Joe Biden appointee, wrote in a 26-page opinion.
