I don't think you understand the part he plays. A smarter replacement may not have been so easily manipulated to follow their plans.
From this image I think they added this policy as a way for them to legally deny a request if they determine it will overuse their resources or some other arbitrary reason. It has nothing to do with a concern for the well-being of the LLM.
Increased violence is already on their agenda.
