“The idea-expression dichotomy means that copyright has traditionally been understood to exist only for human-created work, and copyright has been similarly understood to be owned only by human beings. Up until recent technological developments, creative implementation has for the most part always had to be executed by humans. The introduction of generative LLMs however disrupts this traditional workflow of idea-expression, as (in the case of wholly LLM-generated work) a human being can now contribute merely the idea, with the implementation and expression of that idea performed by the LLM.Nevertheless, we can see that copyright law across multiple jurisdictions remains mostly clear: the copyright owner has to be a human being, and the copyright should only extend to human-created work.”fsfe.org/news/2026/news-202608#AI #GenerativeAI #LLMs #VibeCoding #Copyright #SoftwareDevelopment #Programming #FLOSS #FreeSoftware #OpenSource

@su_liam While I agree that prompts per se don’t have absolutely any market value, I think there’s a market for people whose prompts are proven to be in general more effective when compared to the ones provided by others to achieve the same tasks. But here we’re talking a service and not so much a product. And I suspect that some companies may have already started to try to patent some specific prompts :o)
